Just got another unreal e mail from the RM… and, after all these weeks, i wonder if (in an imaginary world, with endless money to waste) ..a legal action would be somehow feasible..

“Dear Mr XXX , thank you for your email, I hope you are well.

I can see that your order is just awaiting stock which we plan to retrieve within the next few weeks. Your order will then be despatched. I apologise for the delay.

FACTS

I placed my order on the very same day of release (15 november) and i did it within the first half an hour (9,30 ish a.m). I placed my order directly to the god damn producer (not to a whichever dealer) which should be the one crafting and holding the good purchased, and therefore keeping what has been ordered before re selling a % of the rest to its commercial partners (other dealers etc etc). If i am not mistaken the delivery was at that time guaranteed during (for) the first weeks of January. I paid and got my money taken on the 15 November. Quite surprisingly, the proof sovereign has not gone sold out immediately, but has been availabe for weeks and weeks (at some point, with the clear goal to speed up the selling process, the RM officially stated that this coin would have been available “only” until 31 of December, and that the official mintage could have been possibly reduced, after that day.

 

ASSUMPTION

-          Being in a queue, i assume (am i wrong?) that the “rule” first come first served” applies, where my order should be processed BEFORE others placed later on the very same day (for not talking of all the others placed in the following days-weeks).

-          The RM used the last months of 2022 to start minting the proof sovereign (keeping an eye on the still-open purchase option on the website) and related set-s and the first weeks of January to start with the deliveries.

 

FACTS

Hundreds (thousands?) of buyers received their purchase in the last 4 weeks, with the RM totally screwing/ignoring the day (and hours) of the orders’ placement. I got friends (and not only in UK but across Europe) that ordered it at the beginning of December (and not even from the RM) that got it ages ago.

What is the point in trying to be amongst the first and to secure a coin with the highest possible definition (oh yes i am talking about a damaged die, or just a “tired” one) if then no one gives a *°*° and, with more than a month’s delay, you receive an e mail like the one i got yesterday?

THEY PLAN TO RETRIEVE STOCK IN THE NEXT FEW WEEKS (WTF?); retrieve from where if i may ask?

Conclusion;

Isn’t the RM breaching a contract i “signed” when i paid for something that should have been delivered a month ago? Should’t they pay a legal inerest for the money taken with no compliance whatsoever of their part of the contract? I bought my good directly from the producer, not from a delaer, therefore their statement about the need to retrieve  a stock sounds totally unacceptable. And i m not even talking about the quality of the product (that i hope will be satisfactory)

p.s not even keen in properly writing Nikita... what the hell is NIKKITTA a pornstar nick name?

I ordered my coin and paid for it in November and I had an email over the weekend confirming that my order would be despatched to me 'by early April, at the very latest'.

BU Five Sovereign Piece.

Maybe, but realistically the only redress you'll get is to have the order cancelled and your money back (which RM will probably do if you ask them anyway). You're not likely to get any sort of interest unless the contract says otherwise (which it won't).

I share your pain and frustration.
We coin fanatics often come across the term "First Strike" where the first minted coins achieve a marginally better impression.
Whether this affects softer gold coins or not I don't know.
Some proofs also have a serial number and some collectors like to obtain low numbers.
With that in mind if you were first in line to order then you would assume you would get a First Strike AND a low serial number.
Good luck pursuing you mission but I would imagine the stress and frustration you will encounter isn't worth it.

There was a Youtuber who took action against the RM the stress and lengthy battle caused heart problems. The result will only be ill health and an empty bank account , you can't continue to fight a battle with zero funds 🤔

If you are embarking on any course of action that might lead, or worse, force you to take legal action, think again, and then think once or twice more,  whilst you lie down in a darkened room with a damp towel over your head for at least half an hour.

This (entirely personal - and free!) advice is based on three claims that I have pursued in the so-called 'small claims court'. They took place intermittently over the course of 40 years, so I was not exactly a perennially litigious person. But, even at this humble, supposedly simple and straightforward, and fairly inexpensive level of the English court system (I represented myself), they were far from trouble free. 

Indeed, over the years the cases became more and more difficult to pursue, even though I was successful in each case. In my last claim, I initially encountered a deputy district judge who was both totally ignorant of  basic consumer law and biased in favour of the female (and very stupid) defendant. (I believe that the judge was a failed solicitor and burdened with feminist prejudices.) Consequently, it took three tiresome visits to a county court 40 miles away to achieve justice. I recovered hardly any of my expenses in this case, though I did recover the principal sum in dispute.

A legal action is clearly something not worth the effort (and the money wasted); what surprises me a lot is i haven't read in your comments anything about the discrepancy between queueing (getting a priority etc etc) and then having to wait when people that ordered way later are having their goods dispatched.   

this is of course not a matter of principle but of substance. Why should i get one of the last proof sovereign minted with a die when i bought it amongst the firsts? in today's numismatic world, obsessed with first strikes, ms67, pf70 etc etc etc i "invest" money and i realize timing is essential. 

I dont see this right protected anyhow here

I wonder whether the RM found itself contractually obliged to fulfil all its orders from its authorised distributors first, before it fulfils its direct orders from individuals like you and me.

Meaning that if you and I had ordered it from the likes of Chards, BBP etc - with a discount as well - we may well have received our coins some time ago.

It's really poor whichever way you look at it, especially since you can get the Memorial Bullion Sovereign coins before they have delivered all the proof and BU versions.
Shame on them.

what to me is really not acceptable is that RM keeps on hold buyers (like me) that bought directly to the RM itself on the very same release day, while other suppliers (like chards) got it back on stock now and (i guess) ready for IMMEDIATE delivery.

(and 15 gbp cheaper)

for not talking about (this really matters to me) the totally screwed prioriry order. I ll get one of the last proofs, when i bought mine amongst the first

honestly what is the point in buying from the RM? more expensive and getting a random product, most probably minted amongst the last ones

Cancel the order and buy from a secondary supplier that actually has the item you want in stocks. Be careful as the terms and conditions of the sale always and I mean always protect the seller rather than the potential buyer

Sometimes direct RM customers will get their coins earlier than via dealers. It must be easier for them to ship 10 consignments totalling perhaps 1000 coins, than 1000 separate packages containing one coin per package.

@MJCOIN had a great suggestion, but I guess you stilll bear a grudge against @ChardsCoinandBullionDealer and me, for correcting your half truths about us a few years back.
